Prior applicants need not apply **This is a Full-Time Position** INTRODUCTORY STATEMENT: The Office of the Attorney General, Department of Legal Affairs (OAG) is a pre-eminent, constitutional office, which serves as the chief lawyer to all state agencies and provides legal protections for Floridians against fraud and through the enforcement of the state’s laws. The OAG, is a cabinet agency in the executive branch of Florida state government. MINIMUM REQUIREMENTS: Membership in the Florida Bar and three years of professional experience in the practice of law, legal research, teaching law or in administrative or judicial hearings. JOB SUMMARY: This position is in the Consumer Protection unit in Fort Lauderdale. This position entails primarily civil investigations and prosecutions of large businesses who engage in unfair and deceptive trade practices, deals with complex civil litigation, and securities fraud and involves some travel out of state. This position requires as a prerequisite to employment a degree of Bachelor of Laws or Juris Doctor from an accredited law school. Represents the Office of the Attorney General, Department of Legal Affairs, in trial and appellate courts and administrative tribunals in proceedings relating to Chapters 501, 542, 812, 817, 895, and 932 of the Florida Statutes, the Florida Administrative Code, and other state and federal laws enforced or utilized by the Office of the Attorney General. Participates and supervises investigations of alleged consumer protection violations by individuals and corporate entities, both licit and illicit; reviews reports of law enforcement officers, investigators, accountants and financial analysts; locates and obtains documentary evidence. Directs the investigation of potential violations of state and federal consumer protection and trade practices law; gathers and evaluates evidence and prepares cases for appropriate legal proceedings. Conducts litigation of consumer protection cases in state and federal courts, including preparing pleadings, motions, memoranda of law and briefs; prepares legal research and evaluates the research of investigators; prepares subpoenas, conducts discovery and other pretrial proceedings. Attends trials, hearings, and appellate oral arguments in court. Computer use is required for the preparation of pleadings, briefs and other documents. Negotiates settlements, assurances of voluntary compliance and issuance of cease and desist orders; drafts settlement agreements. Participates with other states through the National Association of Attorneys General (NAAG) by representing the State of Florida in multistate investigations and litigation. Conducts legal research and assists in preparing legislation proposed by the Department. Represents the Department in meetings and conferences relating to consumer protection investigations and litigation. Establishes lines of communication with local, state and federal law enforcement officers and prosecutors; serve on federal and state task forces and work with those agencies; initiates contact with and process information from law enforcement agencies to locate appropriate consumer protection cases. Assist and advise attorneys in trial, pleading, practice, and procedures. Maintains current expertise in areas of practice, including reading recent judicial decisions and case summaries and attending continuing legal education and other professional seminars. Performs in a timely fashion other assigned duties, which may require extended hours and/or travel outside the worksite.
